TERMS & CONDITIONS: The LED Group Australia Pty. Ltd. ROBUSGO Loyalty Program (AU)

1.            About

These Terms and Conditions, together with The LED Group Australia Pty. Ltd. Privacy Policy which is incorporated by reference into these Terms and Conditions (available at www.robusgo.com.au) and the Collect Points form contain the entire understanding and agreement between the Promoter and the Claimant of Points in relation to the ROBUSGO Loyalty Programme (“Program”). Information on how to collect points (“Collect”) and qualify for the Program forms part of these Terms and Conditions. By entering the Promotion, you are deemed to have accepted these Terms and Conditions.

The Promoter of the ROBUSGO Loyalty Program is The LED Group Australia Pty Ltd of 9/210 Queensport Road, Murarrie, QLD 4172, ACN 142 065 003 (“Promoter”). The Promoter operates under the ROBUS brand name and distributes lighting fittings across Australia and New Zealand.

2.            Program

Details of the Program, including the ROBUS product models, period of promotions, minimum purchasing quantities, participating authorised ROBUS agents, or points value are available at www.robusgo.com.au. The details of each Promotion under the Program will be available on the Campaign Page for the period of the Promotion. Assuming the Claimant has enough Points Balance, the Program points will be available for redemption for a maximum period of 1 year.

3.            Eligibility and Participation

3.1          Authorised ROBUS agents are ineligible to participate in the promotion. Authorised ROBUS agents means all wholesalers who have an active account directly with The LED Group Australia Pty Ltd. Employees and the immediate families of the Promoter and of the Promoter’s retail and wholesale partners and agencies associated with this Promotion are ineligible to participate in the Promotion. Immediate family means any of the following: spouse, de-facto spouse, child, step-child (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step- brother, stepsister or 1st cousin.

3.2          Excluding those legal entities ineligible to participate referred to in clause 3.1, the Promotion is open to all other Australian residents 18 years and above, and all other corporations, companies, body corporate bodies, groups, organisations and any other corporate bodies and non-corporate bodies (“Claimant”) to participate.

4.            Claim and Redeem Points

To collect points under the ROBUSGO Loyalty Program, the Claimant must:

a)            as set out in the Campaign Page available at www.robusgo.com.au, purchase specific ROBUS product models from participating authorised ROBUS agents during the Promotional Period. Trade seconds products are excluded.

b)            visit https://www.robusgo.com.au and:

1.      Fully register for a ROBUSGO account (or log into your existing ROBUSGO account if the Claimant already have an account);

2.      To collect points, go to the “Collect Points” Form and Select Claim Points (“Claims”) under Claim Details. Complete all fields on the official collect points form.

3.      upload a clear and legible scan or photo of the fully paid tax invoice (“Proof of Purchase”) indicating store name, store location, invoice number, invoice date, product model purchased, quantity purchased, and amount paid for the ROBUS products.

4.      Please tick the box that you agree to the Terms and Conditions as set out by ROBUSGO, and press SUBMIT.

b)            The Claimant’s submission will be validated by the Promoter. Validation can take up to 10 days after successful submission of Proof of Purchase. Any transactions qualifying for points will automatically be allocated to the Claimant’s account with ROBUSGO. Claimants who have provided a valid email address and valid Claim may receive confirmation by email that they have successfully qualified for the points under the Program.

c)            Points allocated, can be redeemed for vouchers when the Claimant had accrued enough points (“Points Balance”) to redeem for their targeted voucher. Please see points redemption/voucher table below:

d)            To Redeem points, the Claimant will go to the “Redeem Points” Form and review the Points Balance.

1.                Assuming enough Points Balance, the Claimant will select the value of the voucher.

2.                Select SUBMIT

3.                Claimants who have provided a valid email address, will receive an email with their ROBUS Voucher and instructions how to convert into any of the selected retailers’ “Electronic Gift Cards” of the same value.

4.                Follow the instructions as outlined on the email by GiftPay.

5.                As soon as the Claimant has received the email as described in Clause 4.d.3., the transaction between the Promoter and the Claimant will be considered settled. The new Points Balance after redemption will be displayed on the Claimant’s account.

5.            Claim Form and Proof of Purchase

a.            Claims, and Proof of Purchase must conform to the following conditions:

1.      Full copy or picture of the Proof of Purchase must’ve been uploaded and submitted

2.      Proof of Purchase Invoice date must not be older than three (3) months, or in any case be older than the Program launch date. The Program launch date is 15/06/2018.

3.      Proof of Purchase can only be used once.

4.      Only points for ROBUS products can be claimed. Products from other suppliers on a Proof of Purchase will not accrue any points.

5.      A Proof of Purchase can contain product codes from other suppliers. Those products wouldn’t affect the validation; however, no points will be allocated for products other than ROBUS branded products.

b.    Claims are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt. The Promoter and its associated agencies or companies accept no responsibility for lost, late, incomplete, indecipherable or illegible or misdirected Claims.

c.     Subject to Clause 4, Claims received without the proof of purchase will be deemed invalid and will not be processed. Incomplete, indecipherable or illegible Claims will also be deemed invalid.

d.    The Promoter reserves the right to validate and check the authenticity of the Claims and Proof of Purchase, and to disqualify any Claimant for tampering with the claim process, or who submits a Claim that is not in accordance with these Terms and Conditions. Any Claims made with stolen, forged, mutilated, unrecognised or tampered with proof of purchase will be deemed void and no points will be made on such Claim.

e.     Every valid Claim will accrue points which will be added automatically to the Claimant’s Points Balance. Every ROBUS product has a minimum of 1 basepoint per unit allocated. Valid points will be accrued according to the Earnings table per Tier for each Tier level:

Example: RC9WDLCCT3-01 has 1 Base Point per unit allocated. A Claimant (currently a Bronze member of the Program) submits a valid Claim and Proof of Purchase for 40 x RC9WDLCCT3-01. The Claimant will qualify for 40 base points, calculated as follows: Base Point x Tier Multiplier.

f.             All Claimants’ Membership Tier levels will be set to Bronze once they’ve joined the Program. Based on activity and the number of points accrued within a 12-month period from joining the Program, or Annual Anniversary of Membership to the Program, a Claimant could be upgraded to higher Program Tier levels.

To qualify for upgrades or retention of Tier levels, a Claimant must collect or maintain points according to the Tier Level Table below:

g.            The Claimant is responsible for providing accurate account details and the Promoter will not be responsible for rejection of Electronic Gift Cards due to incorrect details provided by the Claimant or any costs associated with locating these monies.

h.            A separate Claim Form and Proof of Purchase for each Claim must be submitted in accordance with the requirements set out in Clause 4.

i.             The Points Balance cannot be transferred or exchanged for anything else than what has been offered under the Program.

j.             If a Claimant claims the Cash Back offer and later returns or exchanges the Product, including due to a defect in the Product, in accordance with law and the relevant Authorised ROBUS Agent’s Terms and Conditions of sale, then the amount refunded or credited to the Participant will be the amount paid for the Product, less the Cash Back amount.

k.            Any tax liability arising as a result of accepting any Gift Cards or Gift Vouchers for any amount is the responsibility of the Claimant.

l.             It is the responsibility of the Claimant to make sure that he/she complies to the policies and procedures of his/her employer. The Promoter and all its participating authorised ROBUS agents, will not take any responsibility for any claims that have been made by the Claimant in direct conflict to the policies and procedures prescribed by the Claimant’s employer.


6.            Liability and indemnity

To the extent permitted by law, the Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or Claim Form to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to the Claimant’s or any other person's computer related to or resulting from participation or downloading any materials in connection with this Promotion.

If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, acting reasonably, to the fullest extent permitted by law: a) to disqualify any Claimant; or b) to modify, suspend, terminate or cancel the Program or any part of the Promotion, as appropriate.

7.            Miscellaneous

The Promoter's decisions are final, and no correspondence will be entered into. Any costs incurred by the Claimant associated with claiming points under the Program including accessing the ROBUSGO website, telephone enquiries in relation to the Program, and mailing the Claim Form are the sole responsibility of the Claimant.

Headings and subheadings are inserted for convenience only and shall not be used to interpret the text of these conditions in any way adverse to an interpretation in favour of the Promoter.

8.            Privacy

The Promoter’s collection, use and disclosure of personal information (“PI”) is subject to The LED Group Australia Pty Ltd Privacy Policy (available at www.robusgo.com.au) and is incorporated into this agreement. The Promoter collects PI in order to conduct the Promotion, and may for this purpose, disclose PI to third parties, including but not limited to agents, contractors and service providers and to any Government authorities and agencies.
